General Terms and Conditions of Business (GTCB)

Provision of rooms

Reserved rooms are available to guests as from 15.00 hrs. Insofar as no later arrival time has been explicitly agreed, we reserve the right to reallocate any rooms ordered but unoccupied after 19.00 hrs.

Guests acquire no right to the provision of specific rooms or premises (event). Should agreed premises be unavailable, we undertake to try and find equivalent replacement premises in house or elsewhere.

We reserve the right if necessary to reallocate reserved tables 30 minutes after the time for which they have been ordered.

House guests have no priority right to a certain seat or any seat at all; we will however try to offer house guests a place at all times.

Changes to orders and cancellations

Accommodation (up to and including 14 persons: individual guests) – the following terms apply to booking changes and cancellations:
> Up to and including 3 nights – you can cancel or rebook as many days free of charge in advance as you have booked to stay.
> 4 nights and more – you can cancel or rebook twice as many days free of charge in advance as you have booked to stay.

Individual guests are obliged to pay the agreed price for any contractual services they do not utilise, minus the costs saved by the hotel for bed and breakfast amounting to 15 % and bed and half board amounting to 30 % of the agreed service.

Accommodation (15 persons and more: group arrangement):
For allocations for 15 persons or more (group arrangement), the following terms apply to booking changes and cancellations:

Up to and including 60 days prior to arrival = full cancellation possible
Up to and including 30 days prior to arrival = up to 50 % cancellation of the nights’ accommodation agreed
Up to and including 10 days prior to arrival = up to 20 % cancellation of the nights’ accommodation agreed
Up to and including 5 days prior to arrival = up to 10 % cancellation of the nights’ accommodation agreed

Group guests are obliged to pay the agreed price for any contractual services they do not utilise, minus the costs saved by the hotel for bed and breakfast amounting to 20 % and bed and half board amounting to 35 % of the agreed service.

Should these terms and deadlines not be applicable to short-term or arrangement reservations, the cancellation and rebooking terms and deadlines agreed individually in writing are to apply. Should the agreed duration of stay exceed 90 nights’ accommodation, the above-mentioned deadlines are doubled in each case. As a general rule, we will always try to reallocate such accommodation services as guests fail to utilise. Until such time as rooms are reallocated, guests have to pay the amount calculated above for the agreed term of contract.

Events

The following terms and deadlines for rebooking and cancellation apply to agreed events and the provision of premises:

Up to and including 10 participants = 1 week
Up to and including 20 participants = 2 weeks
Up to and including 30 participants = 4 weeks
Up to and including 50 participants = 6 weeks
More than 50 participants = 12 weeks

Should contracting parties fail to comply with the terms and deadlines stated, they are liable in full for the services agreed. In the case of accommodation that is not utilised, the liability amount is reduced by 20 % for cost savings. For agreements on catering service provision, a reduction of 40 % for cost savings is granted up until 48 hours prior to the commencement of the event. The consumption of beverages is calculated on the basis of the average value at our hotel amounting to EUR 8 per person per meal. As a general rule, we will always try to reallocate such services as are not utilised, whereby the liability amount owed by the contracting party is reduced by the income we earn from so doing. Event organisers are kindly asked to provide us with a list of participants by no later than 48 hours prior to their arrival as the hotel cannot otherwise guarantee the due smooth processing of the booking. The same applies to a larger number of participants than that agreed. Should there be justified reason for assuming that the event would compromise the smooth running of the hotel’s business or the safety, security or reputation of the hotel or its guests, as well as in the case of force majeure or strike, we may withdraw from the contract.

Proof of loss

As far as accommodation/events are concerned, we reserve the right to provide proof of reduced cost savings in the case of non-utilisation of services. The contracting party has the explicit right to prove that the actual costs savings are higher than those set out here.

Deposit

Should advance payments requested by us fail to be made by the deadline stated (insofar as no deadline is stated – no later than 10 days prior to arrival or the commencement of the event), we are thereby released from our obligation to comply with any undertakings directly agreed.

Binding nature of offers

The prices stated are inclusive prices with service charges and sales tax (VAT) included in them. Should the period between conclusion of contract and service provision exceed 4 months, we reserve the right to implement price changes without prior notice to this effect. Changes in the value-added tax rate are charged to the customer irrespective of the point in time of contract conclusion. All price indications and agreements are in euros. Insofar as other currencies are quoted, the exchange rate valid at the point in time of publication is exclusively considered to provide non-binding guidance.

Confirmations

The order is deemed to be legally binding upon acceptance of the offer (by e-mail/fax/post or by telephone).

Payment

Invoices issued to guests are payable immediately in cash or by EC card. All guest accounts are payable on a weekly basis.

Invoicing

Invoices despatched on the basis of the previous credit agreement are payable within 10 days. Outstandings exceeding the payment deadline are subject to payment of interest in accordance with § 288 sect. 1 et seq. of the German Civil Code. We are entitled to refuse foreign currency and credit cards or destroy invalid ones. Cheques are not accepted as a matter of principle!
The following credit cards are accepted: American Express, Maestro, Visa, Mastercard/Eurocard. A charge of 3% per credit card payment is due with immediate effect.
Vouchers from tour operators are only accepted if we have a credit agreement with the company concerned or if the corresponding advance payments have been made. Vouchers cannot be redeemed in cash.

Exclusion of third parties

Claims and rights arising from agreements concluded with us may only be assigned to third parties with our consent.

Liability

The hotel’s contractual partners or guests as such or as hosts are fully liable for the damage caused by themselves or their guests.

Any usage of rooms or premises provided to guests deviating from that set out in the agreement entitles us to cancel the contractual relationship without notice and without our claim to the agreed charge being reduced thereby.

In the absence of any provision to the contrary, our liability including that of our staff is limited to that attributable to wilful conduct and gross negligence.

The hotel can be held liable for a maximum amount of EUR 600.00 per hotel room. The hotel’s liability is ruled out if the rooms and/or containers in which guests leave their personal items are not locked. Liability is assumed for money and valuables up to a maximum amount of EUR 800.00 per guest insofar as the money and valuables concerned are openly handed over to the hotel reception for deposit in the hotel safe and a receipt is issued for them. No liability whatsoever is assumed as a matter of principle for gifts and/or valuables brought on to or received on the premises at parties, festivities or celebrations.

Departure

Guests are kindly asked to notify the reception of their departure by no later than 10.00 hrs. Guests are kindly asked to depart by no later than 11.00 hrs in the absence of an arrangement to the contrary agreed with the reception.

Pets

Any damage to persons and/or property of any kind caused by a pet owned by the guest or brought on to the premises by the guest must be compensated in full by the guest.

Third-party services

Any third-party services brokered and/or charged for by the hotel are subject to payment of a surcharge. The hotel however assumes no liability for such third-party services.

Wake-up orders

We will always try to carry out your wake-up orders with the greatest care and diligence. Compensation claims for any failure in this respect are however ruled out.

Lost property

Any items left behind by guests will only forwarded to them on request and subject to payment of a charge. We undertake to keep such items safely and securely for a period of 6 months. After this point in time, the items will be handed over to the local lost property office insofar as they have any obvious value.

Mail and goods consignments

Messages, mail and goods consignments addressed to guests will be handled with care. We look after the safe-keeping, delivery and, if requested, the forwarding of same. Any liability for loss, delay or damage is however ruled out.

Data processing

We use EDP in our work and have stored your name, address and any other data required in connection with this matter.

Internet usage in the hotel

The General Terms and Conditions of Business (GTCB) of Flexfast GmbH apply.

Should individual provisions set out in our General Terms and Conditions of Business be invalid, the validity of the other provisions remains unaffected by this.
